I think it is great to try to get the laws changed to allow Surly, as well
as other small breweries, to sell growlers at the brewery.
However, I don't see that this creation of a new license will accomplish
what we're trying to do. If the noted changes are made to the statute, a
new "temporary" license will be created where a brewery producing between
3,500 and 7,000 bbl per year will be charged $1000 for a license and will be
required within two years if they want to be a brew pub or a production
brewery.
Subdivision 7, paragraph (b) of Statute 340A.301 states:
"...a brewer who holds an on-sale license issued pursuant to this paragraph
or a brewer who manufactures fewer than 3,500 barrels of malt liquor in a
year may, with the approval of the commissioner, be issued a license by a
municipality for off-sale of malt liquor produced and packaged on the
licensed premises..."
If I remember my research correctly, this is the paragraph that was added or
modified when the original "Growler Bill" was passed.
This is the statement that needs to be changed to read "7,000 barrels" if
Surly were to be allowed to continue with growler sales.

I also contacted my representative (district 40A, Burnsville) and got a
positive response. He appreciated the need to defend local small business
from arbitrary laws that the current legislation killed Darkness day over.

that should be supported and that the products that they produce are
different from the major brewers. These products are of interest to a
segment of the population that appreciates these less common styles of
